Understand How Chapter 13 Bankruptcy Works

Chapter 13 Bankruptcy lets you rearrange your financial affairs, perhaps even repay only a portion of your debts and put yourself back on your financial feet. Based upon the unique characteristics of your financial situation, our Attorneys can write a repayment plan which may allow up to 5 years to re-organize your financial affairs. This plan could allow you to payoff past due mortgage payments and arrearages on your home at a rate you can afford so long as a certain minimum payment level is met. 

Additionally, a portion or even all of your unsecured debt, i.e. Credit Cards, Medical Bills, Utility Bills, Personal Loans, etc., may actually be discharged if your situation warrants. A debt that is discharged never has to be repaid! Every month this could free-up extra money so that you will be able to continue making the payments according to your individual Chapter 13 plan.

Chapter 13 is also known as a reorganization or repayment bankruptcy. Provided that you have a steady source of income and can make your monthly mortgage to be able to cure your mortgage arrears over five years, you may be able keep your house.

If you have a high interest rate loan that is secured by a car or other item of personal property, a Chapter 13 Bankruptcy Attorney can negotiate on your behalf with the lender to have the interest rate reduced to a reasonable level.
